Terms and Conditions
on online learning of foreign languages via Skype

A legal entity - entrepreneur Posobchuk V, hereinafter referred to as the “Contractor”, registered in The United State Register of Legal Entities, Individual Entrepreneurs and Public Organizations of Ukraine on the 09.08.2021, № 2010350000000028413, publishes this Contract for conducting distance learning in German, English, Italian, Spanish, French and Polish, offered to any individuals and legal entities, hereinafter referred to as the "Client".
This contract is a public offer agreement in accordance with Article 633 of the Civil Code of Ukraine and contains all the essential terms of the contract for paid services. Acceptance of the offer is recognized by the Client’s payment for studing according to the Agreement, using the details of the Contractor specified in this Agreement.
1. THE SUBJECT OF THE AGREEMENT
The subject of this Agreement is the paid individual or group learning of the Client in one of the languages mentioned on https://cosmoskype.com via the Internet, using telecommunication means and software (Skype, etc.).
2. OBLIGATIONS OF THE Contractor
2.1. Provide teaching services in foreign languages (English, German, French, Spanish, Italian and Polish) to the Client in accordance with the program ordered in any number of academic hours paid by the Client (one academic hour - 50 minutes), according to the price list (current prices are available on the page https://cosmoskype.com/price).
2.2. Provide a learning process with a qualified teaching staff.
2.3. Provide the Client with the necessary electronic studying materials and worksheets, the cost of which is included in the cost of learning.
2.4. Schedule classes according to the agreements with the client.
2.5. The Contractor undertakes to conduct classes that did not take place due to his fault in the full amount and time agreed with the Client.
2.6. Report the date of the first class through the Skype communication system, via e-mail or by phone specified by the Client.
3. OBLIGATIONS OF THE CLIENT
3.1. In time and in full amount pay to the Contractor the cost of the Services rendered in the manner, within the terms and in the amount, established by clause 4 of this Agreement.
3.2. Attend all classes provided by the schedule of classes drawn up directly with the teacher.
3.3. Scrupulously and timely do homework.
3.4. Compensate the classes that did not take place due to the fault of the Client.
3.5. Notify the Contractor about the rescheduling of the lesson, no later than 2 hours before the start of the lesson by phone, viber or skype. In case of non-fulfillment of this condition, the Client pays for the lesson missed.
3.6. Do not disclose confidential information and other data provided by the Contractor in connection with the execution of this Agreement, do not disclose such facts or information (except publicly available information) to any third party without the prior written consent of the Contractor.
4. CALCULATIONS AND PAYMENT ORDER
4.1. Payment for the Contractor’s Services is made by the Client by 100% prepay for the desired amount of academic hours (the recommended number of prepaid lessons is 5 or 10), no later than 2 (two) banking days before the start of the next period for the service delivery (depending on the schedule).
4.2. Payment is made from the website on the Payment page (https://cosmoskype.com/payment_wfp) or using Visa / MasterCard of any bank. It is also possible to pay with the help of such services as PayPal.
4.3. The contractor does not recalculate the payment in case of absenteeism by the Client, which did not take place due to the fault of the latter.
4.4. The cost of the Services may vary depending on market conditions, which is reflected on the website. The Contractor cannot change the services for a particular Client if he has already accepted the terms of the Contractor and paid for the training in accordance with the procedure established by this Agreement.
5. REFUND POLICY
5.1. Money for unused lessons can be refunded on the request of the Client in case of completion of the course of study (or a break for a long period), but no later than one month from the date of the end of the course (or from the date of the last lesson, in case of a break for a long period).
6. TERM OF AGREEMENT
6.1. This contract comes into force from the moment of the first payment of the client and is valid for different periods of time, depending on the number of paid lessons.
6. ADDITIONAL CONDITIONS
6.1. The Contractor has the right during the course of training to change the teacher if necessary, but not more than twice a month.
6.2. The client has the right to reschedule the classes to any convenient day, coordinating the date and time with the teacher no later than 2 hours before the start of the class according to the new schedule.
6.3. The client has the right to refuse from the course, in case of the Contractor’s failure to fulfill obligations of this contract. The amount of the return of the contract is recalculated, based on the classes held, and taking into account the commission described in paragraph 5.1. of this agreement.
6.4. The client has the opportunity to get the first trial 30-minute-lesson with any teacher. The client can have as many trial lessons as necessary in order to find a suitable teacher. There can be only one trial lesson with one teacher. The first trial lesson the client receives for free, all subsequent trial lessons are paid in the amount of 5 euro for one trial lesson.
